i knew this too, so really scooter only performed the song
they didnt even credit them selfs

i wonder if they did this because they really got they idea from ferris?

anyway, future production of this track in anyway could always just add ferris name in the credits to make it easier to do
lets face it
if ferris did get the rights and re released it, it wont go nowhere, its already had its day
even a remix version proberly wont do so good

and once people find out that ferris an x member is re reaseing a scooter track it would just go sour
that is if he did get rights, i cant see this goint to far

to me this is all pointless

I have just got my Nessaja single out - it says:

""All tracks written by Maffy / Zuxkowski", so Scooter never claim to have written it....

Exactly, so where's the real problem ? Not in the credits, so nothing official to prove there. The credits of Ferris are in the idea of the track I suppose, but that;s almost impossible to be legally proved I would say ..... confusing situation really ..... If Scooter haven't credited themselves in the track, I suppose Ferris could also not be credited in the track, because Maffay's and Zuchowski's record company's maybe insisted on the fact that only M & Z may be credited if Scooter cover the chorus. ;)

Upps - I should know that - I just happened to pick out the Aus single when I was looking to see what it actually said on the disc, and the Aus single has a typo on it and spells it Maffy
.... just looked through my collection only the Aus singles has it spelt this way (it is correct on the Aus album) ,the rest are correct - I had not noticed before :)

I suppose the fact the name SCOOTER is on the front cover is Ferris' problem. Because as far as I can judge, legally none is credited to have made that song, besides the original song writers. ..... difficult this all :S

Well, Scooter have mixed and programmed all their songs, but the writing of the songs are another story.

To look at MTG, Martin Gore is the only name credited for Stripped, as he and Depeche Mode made it.
On UTROTT, Colin Vearncombe is the only name credited for TSAMH, because of the Wonderful Life part.

So Nessaja isn't the only one.

Scooter stole the lyrics for Nessaja too?

The break is stolen, but they re recorded it and covered with their unique HPV. So are the chord progressions, but I'm sure they made all the timbres or have the rights to them, so the track is at least 50 percent theirs. But what does Ferris have to do with any of this?

I've made summary at my www-page some days ago:

Situation with Ferris messages on his facebook account was cleared. And also predictable :) He said: "Don`t get me wrong: I`d love to see them successful! BUT with their OWN ideas. There will be a big lawsuit about the most successful Scooter track ever - that has been written by me... ( talking `bout the english version and all additional hooklines) - "Nessaja". I would never have taken any action...until they`ve send me this letter from their lawyer: he wanted to ban me from saying that I have been the author of the Nessaja version of SCOOTER. This has been my last post about this unpleasant issue. some people think I`d like to get some attention...don`t like attention. Just want to tell the truth! But from now on: let the justice decide".

Let me remind you: track firstly was released on Strom records as Funky Divas "Nessaja" with Topmodelz remix. In authors was only authors of original 80s song. Scooter denied that it's their track & prepared "Habanera" as single that time. But after some threads, votings & protests on official forum 3AM "Nessaja" vinyl was released on Kontor & Jens Thele said that "Nessaja" will be next Scooter single. When it was released we found same Topmodelz remix, but in credits in addition to authors of original 80s song we saw HP (lyrics & shouts), Nikk (female vocal), Jay Frog & Rick (mixing & engineering). But 5 years ago Ferris said that he produced english lyrics & all pre-production for "Nessaja" with Axel Coon for another project. H.P. just added MC shouts, Jay created bassline. Дonfirmation of this could be found on lost web-sites of Axel Coon & Ferris (Nuturn) - discographies sections of which contain 3AM "Nessaja".

If Axel Coon was involved in Ferris' Nessaja-version Scooter could have had the right to use those pre-productions. As far as I know the production of Nessaja had started in the time before Coon left the band. And Coon as a bandmember could have used his (and Ferris') own ideas for the Scooter-Nessaja-production. After Axel had left the band Scooter continued with the work on Nessaja with Jay's bassline.
The work on "HMITF?" started also with Ferris as bandmember and after he had left the band, they finished the song together with Axel.

pre-production by Ferris & Axel was done for another project, not Scooter. Seems to be for "Funky Divas".
I read somewhere that it was offered to Scooter, but Scooter decline offer. After Funky Divas first success Scooter released same vinyl as 3AM on Kontor.

Just a thought, but I wonder how Ferris will react that Scooter do a remake of a track he made in his Scooter time together with the guys. I supose he will be credited, so will get some money out of it, but does he also have to give permission ?
